If you are a foreigner planning to work legally in Vietnam, you may need a Vietnam work permit before starting employment, unless you are eligible for a work permit exemption under Vietnamese law.
A Vietnam work permit is an official document issued by the competent Vietnamese authority that allows a foreign employee to work legally in Vietnam for a specific employer, job position, and period of time.

Important Update
Vietnam Made Easy Travel does not currently provide work permit application services or submit work permit applications on behalf of foreign employees or employers.
Under current procedures, the work permit application should be handled directly by the HR/Admin department of the company, organization, school, representative office, or employer in Vietnam that will hire or sponsor the foreign employee.
If you are a foreign employee, please contact your employer in Vietnam and ask their HR/Admin team to prepare and submit the work permit application to the competent local authority.
As a travel and visa support company, we can still assist you with Vietnam entry visa support, urgent visa support, VIP airport fast track, airport transfers, and travel-related services, but the work permit itself must be handled by your employer or their authorized legal/HR representative.
What Is a Vietnam Work Permit?
A Vietnam work permit is a legal document that allows a foreign employee to work in Vietnam. It is issued by the competent Vietnamese authority when the foreign worker and the sponsoring employer meet the required legal conditions.
A foreign employee who has a valid work permit is considered to be working legally in Vietnam and is protected under Vietnamese labor law during the employment period.
A work permit is different from a Vietnam visa. A visa allows a foreigner to enter and stay in Vietnam for a permitted purpose and duration, while a work permit allows the foreigner to legally work for a specific employer in Vietnam.
Who Usually Needs a Work Permit in Vietnam?
Foreigners may need a Vietnam work permit if they enter Vietnam to work in one of the following common situations:
- Working under a labor contract with a Vietnamese company, foreign-invested company, organization, school, or employer
- Working as a manager, executive, expert, or technical worker
- Transferring internally within a foreign company that has a commercial presence in Vietnam
- Performing contracts or agreements related to business, commerce, finance, education, science, technology, healthcare, culture, or other professional fields
- Providing services under a contract
- Working for a foreign non-governmental organization or international organization licensed to operate in Vietnam
- Participating in the execution of a project, bid package, or commercial agreement in Vietnam
The exact requirement depends on the foreigner’s role, working period, employer type, and whether the person qualifies for a work permit exemption.
Who Should Apply for the Work Permit?
The work permit application is normally prepared and submitted by the employer in Vietnam, not by the foreign employee personally.
This means the sponsoring company’s HR/Admin department should be responsible for checking eligibility, preparing company documents, collecting the foreign employee’s documents, completing the official forms, and submitting the application to the competent authority.
If you are the foreign employee, you should coordinate closely with your employer and provide the required personal documents, such as passport copy, photo, health certificate, criminal record, degree, certificates, and proof of experience where applicable.
General Conditions for Foreign Workers in Vietnam
To work legally in Vietnam, a foreign employee generally needs to meet the following conditions:
- Be at least 18 years old
- Have full civil act capacity
- Have suitable qualifications, professional skills, technical skills, or work experience for the job position
- Have suitable health for the job
- Not be serving a criminal sentence, have an unremoved criminal record, or be under criminal prosecution according to Vietnamese or foreign law
- Have a valid work permit, unless exempted under Vietnamese law
Depending on the job position, the foreign worker may need to prove that they qualify as a manager, executive, expert, or technical worker.
Common Documents Required for a Vietnam Work Permit
The exact document list can vary depending on the employer, job position, province/city, and the foreign worker’s category. In general, a work permit application may include:
- Official application form prepared by the employer
- Written explanation from the employer about the need to hire a foreign worker
- Valid passport copy
- Passport-sized photos
- Health check certificate issued by a competent medical facility
- Criminal record or police clearance certificate
- Documents proving the foreign worker’s position as a manager, executive, expert, or technical worker
- Degree, diploma, professional certificate, or training certificate where required
- Written confirmation of relevant work experience
- Appointment decision or company documents for managers/executives where applicable
- Documents related to intra-company transfer, service contracts, business agreements, or other working arrangements, depending on the case
- Work permit exemption confirmation, if the worker is applying under an exemption category
Foreign documents may need to be legalized, translated into Vietnamese, and notarized before being accepted by the Vietnamese authority.
Because requirements may vary by local authority and by case type, the employer’s HR/Admin team should check the latest requirements directly before preparing the application.
Basic Work Permit Application Process
The process normally involves the following steps:
Step 1: Employer Checks Eligibility
The employer should first confirm whether the foreign employee needs a work permit or may qualify for a work permit exemption.
The employer should also check whether the foreign worker’s qualifications, experience, job title, and expected working location match the legal requirements.
Step 2: Employer Prepares the Application Dossier
The employer’s HR/Admin team collects the company documents and asks the foreign employee to provide the required personal documents.
This step can take time, especially if foreign documents need to be legalized, translated, notarized, or reissued.
Step 3: Employer Submits the Application
The employer submits the application dossier to the competent authority according to the location and current regulations.
If the application is complete and valid, the authority will review the dossier and issue the result within the official processing timeline.
If the dossier is incomplete or does not meet the requirements, the authority may request amendments or issue a written refusal.
Step 4: Work Permit Is Issued
Once approved, the work permit will state important information such as the foreign worker’s name, passport details, employer, job position, work location, and validity period.
The foreign employee should only work according to the approved employer, position, and location stated on the work permit.
How Long Is a Vietnam Work Permit Valid?
A Vietnam work permit is usually issued for a limited period and cannot exceed the maximum duration allowed by Vietnamese law.
In many cases, a work permit may be valid for up to 2 years, depending on the labor contract, assignment letter, service agreement, project duration, or other supporting documents.
The employer should check the exact validity and extension conditions based on the latest regulations at the time of application.
What Happens If a Foreigner Works Without a Work Permit?
Working in Vietnam without a valid work permit or a valid work permit exemption confirmation can create serious risks for both the employer and the foreign employee.
Possible consequences may include:
- Administrative fines for the employer
- Administrative fines for the foreign employee
- Refusal or cancellation of related residence documents
- Requirement for the foreign worker to stop working
- Possible deportation from Vietnam in serious cases
For this reason, foreign workers should not start employment in Vietnam until their employer confirms that their work permit or exemption status is properly handled.
